Terms & Policies (The “Agreement”)

This Agreement includes a release of liability and a waiver of certain legal rights and remedies. This Agreement applies at all Dawgs House locations and to all its staff including employees, owners, agents and representatives. By signing this agreement, you represent that you have read and understand it in its entirety, and you agree to its terms. We encourage you to seek the advice of legal counsel if you are unsure of its effect.

In consideration for your dog(s) being permitted to come to Dawgs House or use Dawgs House services, you agree to all of the policies, procedures, release, terms and conditions set forth below. This agreement amends and supersedes any prior agreements between you and Dawgs House related to the subject matter herein.

1. ALL DOGS MUST:

• Be current on Rabies, Bordetella and DHLPP and any other state required vaccinations,
• Be spayed or neutered by 8 months of age,
• Be at least 4 months of age,
• Weigh no more than 90 lb,
• Be in general good health,
• Be free of ticks, fleas, worms and parasites,
• Be non-aggressive towards other dogs and people,
• Not be protective of toys, or any other items provided for daycare activities,
• Complete the Dawgs House behavioral assessment process to the satisfaction of Dawgs House in its sole discretion.

2. DOG FOOD:

At Dawgs House, we offer feeding services for dogs under one year of age and for dogs with special needs that require feeding during the day, at a small additional charge. Please note that we do not provide food for daycare dogs. You are required to bring your dog’s food in a container clearly labeled with their name, along with detailed feeding instructions.

For health and safety reasons, Dawgs House strictly prohibits raw foods of any kind.

3. WEBCAM AND VIDEO RELEASE

You are welcome to access the Dawgs House webcams to watch your dog(s) have a great time when your dog(s) attends daycare at Dawgs House. By using the services offered by Dawgs House, you grant permission to Dawgs House to use your dog’s name and photo(s) as well as video(s) taken while at Dawgs House, in any form or format, for use, at any time, in any media, marketing, advertising, illustration, trade or promotional material. Dawgs House may also use video and audio surveillance in the lobby area. You agree and consent not to record, screenshot, copy, reproduce, alter, modify, or create derivative works from any Dawgs House webcam footage.

4. PERSONAL PROPERTY

Dawgs House will not be liable for any lost, stolen or damaged personal property belonging either to you or to your dog(s). If your dog(s) causes any damage to Dawgs House property, you will be responsible for the full cost of repairs and/or replacements.

5. FEES

You must pay for all services at the time you pick up your dog(s) or at the time services are completed. You give your expressed permission for Dawgs House to charge the credit card you have provided for unpaid services or products upon the date services are rendered and completed. You are responsible for ensuring that your payment methods are valid and sufficient to cover the total cost of services rendered by Dawgs House.

In the event that a payment is declined, you will be responsible for any fees, charges, or additional costs incurred as a result of the declined transaction. These may include, but are not limited to, bank fees, administrative fees, or late payment charges. Dawgs House reserves the right to suspend or terminate services until payment has been successfully processed.

6. TRAINING AND INTERVIEWS

You hereby consent to Dawgs House’s use of your dog(s) for staff training, dog training and new dog behavioral assessments while your dog(s) is in our care. New dog behavioral assessments are always conducted under strict supervision by Dawgs House staff.

7. RESERVATION, CANCELLATION AND REFUND POLICY

Please note the following cancellation and no-show fee policies:

• Preferred Cancellation Notice: You must notify Dawgs House of any cancellations at least 24 hours ahead of the scheduled reservation date and time. This allows our team to offer available spots to other customers.
• Last-Minute Cancellation Allowance: You are allowed to make up to three last-minute cancellations in a calendar year without any penalty.
• No-show Fee: If you exceed the allowance of three last-minute cancellations in a calendar year, Dawgs House reserves the right to enforce a no-show fee of $39 per occurrence.

8. AGGRESSIVE DOGS OR OTHER UNACCEPTABLE BEHAVIORS

In order for your dog(s) to attend daycare at Dawgs House, your dog(s) must not be aggressive and must pass the behavioral assessment at Dawgs House’s sole discretion.

If your dog(s) exhibits aggressive or any other unacceptable behavior at Dawgs House’s sole discretion, your dog(s) may be separated from other dogs and asked not to return to Dawgs House.

9. ABANDONED DOGS

You must not leave your dog(s) at Dawgs House after the end of the business day on the day of service. Dawgs House does not offer boarding services and cannot accommodate dogs for overnight care. If your dog(s) is not picked up by the end of the business day on the day of service, Dawgs House reserves the right to hand over your dog(s) to the authorities as deemed appropriate. Dawgs House will make multiple attempts to contact you and your emergency contact(s) on file prior to contacting the authorities. At Dawgs House’s sole discretion, your dog(s) may be placed overnight at Dawgs House as an emergency accommodation or in an overnight care facility. Any and all costs associated with the care and placement of your dog(s) will solely be your responsibility.

10. DUTY TO DISCLOSE

You must disclose on a continuous basis, any and all medical or other conditions, including but not limited to personality concerns or behavioral incidents that may affect, limit or prevent your dog’s ability to participate in any Dawgs House services. In the event of a material change to the information you provided to us, you agree to update your profile and account within 7 days.

11. ACCEPTANCE AND ACKNOWLEDGMENT OF RISK

You fully understand that: (a) there are inherent and potential risks involved with interaction between humans and dogs, as well as between your dog(s) and other dogs, which may result in property damage or bodily injury, including but not limited to, permanent disability, sickness, or death to human or dog; and (b) there may be other risks not known to you or Dawgs House, nor readily foreseeable at this time (collectively, “risks”). You fully accept and assume all risks and responsibility for all risks including, without limitation, all losses, costs, damages incurred as a result of your dog’s participation at Dawgs House, including any veterinarian expenses listed in section 12, below. “Sickness” includes any illness including but not limited to bordetella (kennel cough), bloat, canine flu, or any other form of contagious disease. By bringing your dog(s) to Dawgs House, you consent to the participation in an off-leash group play environment with dogs from other families.

You further acknowledge and consent to the use of safe and effective methods by our trained staff in the event of a dog fight or aggressive behaviors during playtime. These methods include, but are not limited to, the use of bite sticks, the wheelbarrow maneuver, the use of barriers to safely separate the dogs, the use of water spray bottles for distraction, and other non-harmful techniques designed to prevent injury and maintain a safe environment for all dogs. Our priority is the safety and well-being of every dog in our care, and these protocols are implemented with that in mind.

12. VETERINARY CARE

Dawgs House will have the right to obtain medical treatment for your dog(s), if, in Dawgs House’s sole discretion, it appears that your dog(s) may be ill, injured or exhibit any other behavior that would reasonably suggest that your dog(s) may need medical treatment. Reasonable efforts will be made to contact you when Dawgs House determines that medical treatment is necessary, but if Dawgs House is unable to contact you or your emergency contact(s) in a timely manner, Dawgs House and the veterinarian at our partner veterinary hospital, Advanced Animal Care Hospital, may rely on this Agreement as your consent to treat your dog(s). You hereby grant the veterinarian at Advanced Animal Care Hospital, and Dawgs House the right to make medically necessary decisions regarding your dog’s treatment, and release the veterinarian at Advanced Animal Care Hospital and Dawgs House from all liability for the same. If you are unable to be reached but your emergency contact(s) is reached, you hereby grant your emergency contact(s) the right to make medically necessary decisions regarding your dog’s treatment.

Dawgs House will first attempt to seek treatment from the veterinarian provided in your dog’s profile (“Designated Veterinarian”), but will have the right to seek veterinary treatment from Advanced Animal Care Hospital if: (i) the dog needs urgent care, (ii) Dawgs House is unable to reach the Designated Veterinarian, or (iii) Dawgs House is unable to transport your dog(s) to the Designated Veterinarian. If your dog(s) passes away at Dawgs House, it will be brought to its Designated Veterinarian or Advanced Animal Care Hospital.

In the event your dog(s) is injured during routine play, we presume that no dog is at fault, you agree to be fully responsible for all resulting costs related to any medical treatment for your dog(s) including, without limitation, the cost of any transportation for the purpose of such treatment. If Dawgs House staff determines, in their sole discretion, that your dog(s) caused the injury or death of another dog or dogs during or outside of routine play, you will be fully responsible for all costs related to any medical treatment for the injured or deceased dog(s), including, without limitation, the cost of any transportation for the purpose of such treatment. You agree that Dawgs House may release your name and contact information to the parents of the injured or deceased dog(s) to arrange payment for the same.

13. IMMUNIZATION RECORDS.

You agree to provide veterinary records to Dawgs House upon request, and you hereby grant Dawgs House permission to request and obtain veterinary records directly from your Designated Veterinarian, if Dawgs House is unable to obtain necessary records from you. By signing this Agreement, you expressly authorize your Designated Veterinarian to release health and treatment information and immunization records to Dawgs House staff upon request. You may revoke this authorization at any time upon written notice to your Designated Veterinarian and Dawgs House.

14. WAIVER, RELEASE AND INDEMNIFICATION.

YOU HEREBY AGREE TO EXPRESSLY AND FOREVER GENERALLY WAIVE, DISCHARGE CLAIMS, INDEMNIFY, RELEASE FROM LIABILITY, SAVE, HOLD HARMLESS AND DEFEND Dawgs House, their owners, officers, directors, employees, contractors, volunteers, agents, representatives, lessors, and all others having an interest in any Dawgs House party (collectively, the “Releasees”) from and against ANY AND ALL INJURY, LIABILITY, CLAIMS, LITIGATION, ACTIONS, SUITS, COSTS, LOSSES, DAMAGES, ATTORNEY’S FEES, EXPENSES OR DEMANDS OF EVERY CHARACTER WHATSOEVER on account of, arising out of, resulting from or relating in any way to (i) any act or omission of the Releasees, (ii) your dog’s participation at Dawgs House. You agree that this release is binding on you and your successors, heirs, legal representatives and assigns. You also expressly and forever release Dawgs House from any duty to protect you or your dog(s) from injury of any kind, and agree that any implementation of safety precautions by Dawgs House will not waive Dawgs House’s right to be indemnified as provided hereunder, and such precautions will not alter this release. You agree that this constitutes a complete and unconditional release of all liability of Dawgs House to the greatest extent permitted by law and that if any portion of this agreement is held to be invalid or unenforceable, the remainder of this Agreement will remain in full force and effect.

15. SIGNATURES

By signing below, you represent and warrant that all the information you provided to Dawgs House is complete and accurate to the best of your knowledge. You consent to Dawgs House’s use of such information for all lawful business purposes which includes, but is not limited to, providing daycare services to you and your dog(s), operating business, marketing to you, communicating with you regarding your dog(s), and using data that includes information about you and your dog(s) for marketing or other purposes. You agree that Dawgs House may send you email and/or SMS messages regarding your transactions for daycare services, including but not limited to appointment reminders, upcoming reservations, and information and pictures relating to your dog(s) while in Dawgs House’s care, and that your decision to opt in or out of marketing communications does not limit or prohibit Dawgs House’s ability to communicate with you regarding these transactional matters. You further acknowledge and agree that you have read, understand and agree to all the terms and conditions contained in this Agreement, as they may be amended from time to time. You hereby execute this Agreement for yourself and your representatives and assigns. You further attest that you are the legal owner of the dog(s) and if you are not the legal owner or sole owner of the dog(s) for whom this Agreement has been completed, your signature is sufficient to enter into this Agreement for and on behalf of any other owner or representative. You have read the “E-Signature Disclosures” below and consent to the use of electronic signatures for this and subsequent documents, and agree that a true and correct copy of this document may be produced in lieu of the original. Should a copy be produced, you agree that it is legally enforceable and does not affect the terms of the Agreement in any way. No amendments, modifications, or supplements to this Agreement shall be valid unless in writing and signed by both parties.

16. ELECTRONIC SIGNATURES

You may request a paper version of this Agreement or subsequent electronic communications. To request a paper copy of an electronic communication, please contact the Dawgs House team. You have the right to withdraw your consent to receive electronic communications at any time. If you wish to withdraw your consent, please notify the Dawgs House team. You are responsible for the installation, maintenance, and operation of your computer, digital device, browser and software. We only require, at minimum, that you have a working email address that uses a functioning modern app or web browser (such as a recent version of Microsoft Edge, Google Chrome, Mozilla Firefox, or Apple Safari) running on an up-to-date operating system (such as Windows 10, iOS 10, OS X Mojave, etc.). Unsupported apps or browsers may not function properly. Dawgs House is not responsible for errors or failures from any malfunction of your computer, device, browser, or software.

17. EXPRESS CONSENT TERMS & CONDITIONS FOR INFORMATIONAL SMS

By providing your mobile number and opting in to receive informational SMS messages from Dawgs House, LLC, you agree to the terms and conditions outlined below. This agreement governs the receipt of non-promotional text messages containing important information, updates, and alerts related to our products, services, and relevant communications.

1. User Consent: By providing your mobile number and opting in to receive informational SMS messages, you expressly consent to the receipt of such messages from Dawgs House, LLC at the number provided. You understand that standard messaging rates, data rates, and other charges may apply and are your sole responsibility.
2. Opt-Out Option: You have the right to opt out of receiving informational SMS messages at any time. To unsubscribe, reply "STOP" to any message you receive from Dawgs House, LLC. You may also contact our customer support at 702-350-1818 for assistance with opting out.
3. Frequency of Messages: Dawgs House, LLC aims to send only relevant and necessary informational SMS messages. The frequency of messages may vary based on the nature of the information to be conveyed, but we will make reasonable efforts to minimize disruption.
4. Data Privacy: We take your privacy seriously. Your personal information, including your mobile number, will be handled in accordance with our Privacy Policy, which can be found on our website https://dawgs.house/privacy/.
5. Message Content: Informational SMS messages may include, but are not limited to, account updates, service notifications, important announcements, and other relevant communications related to your relationship with Dawgs House, LLC.
6. Terms and Conditions Changes: Dawgs House, LLC reserves the right to update or modify these terms and conditions at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after any such changes constitutes your consent to such changes.
